Customer Services Agreement

Effective Date: 28/10/2025

This Agreement (“Agreement”) is a legally binding contract between you (the “Customer”) and us (the “Provider”). The “Website” referenced herein is www.stockeducation.com. By clicking “Agree,” subscribing to, or using our subscription-based content, products, or services (collectively, the “Services”) provided on or through the Website, you confirm that you have read and agree to all terms of this Agreement. Capitalised terms used but not otherwise defined have the meanings ascribed to them within this Agreement.

1. Term

1.1 Commencement & Duration
This Agreement commences on the date you purchase or subscribe to the Services (the “Commencement Date”) and continues until all Services are terminated under the provisions of this Agreement.

1.2 Service Term
Each Service subscription term (“Service Term”) begins on the subscription purchase date. Subscriptions automatically renew under the same terms (annually or monthly, as applicable), unless terminated in accordance with Clauses 6, 8, or 9 of this Agreement.

2. Services

2.1 Provision of Services
We agree to supply, and you agree to acquire, the Services in accordance with this Agreement. You may only access and use the Services for your personal, informational, and educational purposes related to investing.

2.2 Access & Use

  • You must create and maintain a valid user account (including a secure username and password) to access the Services.
  • You agree to keep your login credentials confidential and not disclose them to any third party. You are responsible for selecting and maintaining a secure password.

2.3 Subscription Management

  • You may cancel your subscription at any time via your account settings.
  • Even after cancellation, you retain access to the Services until the end of your current paid subscription period.

2.4 Website Terms & Conditions
By using the Services or accessing any content on www.stockeducation.com, you also agree to be bound by any additional Website Terms & Conditions referenced there.

2.5 No Financial Advice
All information, data, and content provided by us are for educational and informational purposes only. We are not a registered financial adviser, and no fiduciary relationship is established through your use of the Services. We do not guarantee any particular investment outcome or profitability. You remain solely responsible for your own investment decisions and should seek professional advice where appropriate.

3. Our Obligations

3.1 Standard of Care
We will supply the Services using reasonable care and skill, engaging suitably qualified personnel.

3.2 No Warranty for Fitness or Continuity
While we strive to maintain uninterrupted and error-free Services, we do not warrant that the Services will be:

  • Continuous or accessible at all times,
  • Free of viruses or other harmful components, or
  • Fit for any particular purpose, even if you have informed us of your intended use.

4. Your Obligations

4.1 System Requirements
You are responsible for obtaining and maintaining your own equipment, systems, and internet access to use the Services. You must ensure that your setup is compatible with our technical requirements.

4.2 Permitted Use
You are only permitted to access the Website and Services as instructed by us (e.g., via a standard web browser). You must not use automated scripts, bots, or similar tools to access the Services unless expressly authorised in writing.

4.3 Prohibited Conduct
You must not use the Services in any manner that:

  • Violates any applicable law or regulation,
  • Infringes the rights (including intellectual property rights) of any third party, or
  • Could lead us or any other person to breach a law.

4.4 Restricted Actions
Unless expressly permitted in writing by us, you must not:

  3. Share your login credentials or otherwise allow any third party to access the Services via your account.
  4. Dispute or challenge our intellectual property rights in the Services.
  5. Reproduce, reverse engineer, disassemble, decompile, or create derivative works from the Services or related software.
  6. Introduce Malicious Code (viruses, malware, etc.) into the Services or the systems we use to provide them.
  7. Attribute any output generated via the Services to us as official investment or financial advice.

5. Fees & Payment

5.1 Subscription Fees
Access to the Services requires payment of subscription fees (“Fees”). Fees are billed in advance on either a monthly or annual basis, depending on the plan you select. All Fees are stated in USD unless otherwise indicated.

5.2 Payment
Payment is processed through our secure third-party payment processor (e.g., Stripe). By providing payment details, you authorise us to charge your chosen payment method at each billing cycle until you cancel your subscription.

5.3 Price Changes
We reserve the right to modify our Fees at any time. Any price increases will be communicated to you in advance and will take effect at the start of your next billing cycle.

6. Suspension & Termination

6.1 Suspension for Cause
We may suspend or terminate your access to the Services immediately if:

  • An emergency situation arises (e.g., a security breach),
  • The supply or your use of the Services becomes unlawful, or
  • Continuing to provide the Services poses a risk of death, personal injury, or property damage.

6.2 Breach & Non-Payment
We may also suspend or terminate the Services if:

  • You fail to pay Fees on time,
  • We have reason to believe a third party is accessing the Services through your account, or
  • You breach any provision of this Agreement (including prohibited conduct).

7. Data Privacy & Global Compliance

7.1 Compliance with Privacy Laws
We process your personal data in accordance with applicable privacy laws (including Australian Privacy Laws, the GDPR if you are located in the EU, and the CCPA if you are a California resident), as outlined in our Privacy Policy on www.stockeducation.com.

7.2 Your Rights
Depending on your jurisdiction, you may have rights to:

  • Request access to or correction/deletion of your personal data,
  • Data portability,
  • Opt out of certain data processing activities (e.g., “selling” of data under CCPA).

7.3 Privacy Policy
You acknowledge that by using the Services, you have read and agree to our Privacy Policy, which may be updated from time to time.

8. Refund & Cancellation Policy

8.1 Cancellation
You may cancel your subscription at any time via your account settings on www.stockeducation.com. You retain access until the end of your current billing cycle.

8.2 Refunds
We offer a 30-day money-back guarantee from the date of purchase. If you are not satisfied with the Services within this period, you may request a full refund. Refunds are not provided for unused subscription periods after the 30-day guarantee period, except where required under applicable consumer protection laws. If the Services are defective or not delivered as promised, you may be entitled to a refund or other remedy under relevant consumer protection legislation.

9. Intellectual Property Rights

9.1 Retention of Rights
All intellectual property rights in and to the Services, software, and any related materials remain exclusively with us (or our licensors). No transfer of ownership is intended or implied by this Agreement.

9.2 Prohibited Uses
You must not reproduce, distribute, display, or otherwise exploit any part of the Services beyond the scope permitted by this Agreement.

10. Jurisdiction & Dispute Resolution

10.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of laws principles.

10.2 Forum Selection
You agree to submit to the exclusive jurisdiction of the courts located in New South Wales, Australia. If you access the Services from outside Australia, you are responsible for compliance with any local laws.

10.3 Arbitration Option
We reserve the right to propose arbitration as an alternative dispute resolution mechanism if mutually agreed upon by both parties.

11. User Generated Content

11.1 License Grant
If you post or submit any content (e.g., comments, reviews) on www.stockeducation.com, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating the Services.

11.2 Prohibited Content
You must not post or submit any content that is:

  • Illegal, defamatory, or harmful,
  • Violates the privacy, publicity, or intellectual property rights of third parties,
  • Contains malicious code or links to harmful websites.

11.3 Removal of Content
We may remove or moderate user-generated content that breaches these Terms or any applicable law.

12. Entire Agreement & Amendments

This Agreement and any documents referenced herein (including any Website Terms & Conditions and our Privacy Policy) constitute the entire understanding between you and us concerning the Services. Any amendments must be in writing and posted on the Website or otherwise communicated to you.

By accessing or using the Services, you acknowledge that you have read, understood, and consent to be bound by this Agreement.
